Terms of Service
This is the current version shown during signup and recorded with each acceptance.
1. Who we are and what this is
TableServe (the "Platform") is a software service that lets a restaurant, quick-service outlet, café, bar or hotel (the "Customer") show a digital menu, take guests' orders and requests from a QR code, run its floor, kitchen and reception screens, take reservations and keep records of its service. The Platform is offered to businesses only. By subscribing, the Customer confirms that it acts as a business (Unternehmer within the meaning of § 14 BGB) and not as a consumer.
2. The contract
The contract is formed when the Customer chooses a plan and accepts these Terms, the Plan Terms and the Data Processing Agreement, and the Platform confirms the subscription. Each subscription start, renewal and plan change is recorded in a numbered contract document that is sent to the Customer and kept in the Customer's own data area.
3. What the Platform does and does not do
The Platform is a companion to the Customer's own business systems. It does not process payments, issue fiscal receipts or replace a cash register; the Customer's till, hotel system and accounting remain the Customer's own responsibility. Menu content, prices, allergen and additive information, taxes, food safety and every legal duty of the Customer's trade remain the Customer's responsibility.
4. Plans, prices and payment
Plans, their prices and what each plan includes are described in the Plan Terms. Prices are net of VAT unless stated otherwise. Invoices are issued by the Platform and are payable within 14 days of the invoice date unless the invoice says otherwise.
5. Term, renewal and cancellation
A subscription runs for the period of the chosen plan (monthly or yearly) and renews for the same period unless cancelled by the end of the current period. The Customer can cancel at any time from the Subscription page with effect at the end of the current period; no reason is required. The Platform can end the contract with the same notice, and without notice if the Customer breaks these Terms in a serious way and does not remedy it within 14 days of being told.
6. The Customer's data
Everything the Customer and its guests enter belongs to the Customer. The Platform processes it only on the Customer's instructions under the Data Processing Agreement. The Customer can export all of its data at any time from its own admin, and can restore it from the Platform's nightly copies. When the contract ends, the Customer's data remains available for export for 30 days and is then deleted, except where a law requires the Platform to keep records (for example invoices, for 10 years).
7. Availability and support
The Platform aims for availability of 99.5 % per month, measured at the Platform's servers, excluding announced maintenance windows and causes outside the Platform's control. Support is provided in writing through the panel; the Platform answers within one working day.
8. Acceptable use
The Customer must not use the Platform for anything unlawful, must keep its logins and PINs secret, and must not attempt to access another customer's data. The Customer is responsible for the people it gives logins to.
9. Liability
The Platform is liable without limit for intent and gross negligence and for injury to life, body or health. For simple negligence the Platform is liable only for the breach of an essential contractual duty and only up to the foreseeable damage typical for this kind of contract, capped at the fees paid by the Customer in the twelve months before the event. The Platform is not liable for lost profit or for data the Customer could have exported.
10. Changes to these Terms
The Platform may change these Terms for good reason (for example a change in the law or in the service). The Customer is told at least 30 days before a change takes effect and may object; if the Customer objects, the Customer can end the contract at the end of the current period. Every version is kept, and the contract records which version was accepted.
11. Law and venue
German law applies. The courts at the Platform's registered office have jurisdiction where the Customer is a merchant, a legal person under public law or a special fund under public law.
